The petitioner apprehends his arrest in connection with Baniyapur P.S. Case No.242 of 2015 registered under Sections 342, 376 and 511/34 of the Indian Penal Code. The accusation is of attempt of committing rape on the daughter of the informant by this petitioner and one Nagendra Rai. Submission on behalf of the petitioner is that, in fact, due to misunderstanding and grudge, the present case has been filed by the informant with false allegation of attempt of committing rape on his daughter by the petitioner and Nagendra Rai. The informant on coming to know about the real fact has filed a

Patna High Court Cr.Misc. No.693 of 2017 (2) dt.18-01-2017 2/2 petition to compromise the case. Further submission is that the prayer of the co-accused Nagendra Rai for grant of anticipatory bail has already been allowed by a Bench of this Court vide order dated 12.07.2016 passed in Criminal Misc. No.27344 of 2016. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-IX, Sararn at Chapra, in connection with Baniyapur P.S. Case No.242 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
