The petitioners seek pre-arrest bail in connection with Kotwali (Tilkamanjhi) P.S.Case No. 530 of 2016 registered under Sections 384, 427, 379 and 506/34 of the Indian Penal Code.
Regard being had to the inordinate and unexplained delay of about five months in institution of the First Information Report as also the fact that the police did not find necessity to arrest the petitioners in course of investigation and the petitioners were issued notices under Section 41(1) of the Code of Criminal Procedure and they complied with the terms of notice, in the event
Patna High Court Cr.Misc. No.5669 of 2018 (2) dt.09-02-2018 2/2 of arrest or surrender before the court below within four weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S.Case No. 530 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
