ANJANA MISHRA ORAL ORDER 10-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Benipatti P.S.Case No. 60 of 2014 registered under Sections 406, 420 and 120(B) of the Indian Penal Code. Learned counsel for the petitioner submits that three mobile numbers are indicated in the FIR from which alleged amount was demanded from the informant. The three mobile numbers referred to in the FIR are not the mobiles of the petitioner rather he is the owner of mobile no.9470436968. It is further submitted on behalf of the petitioner that during the course of investigation it transpired that the money was deposited in the account of four persons, namely, Sanjay Mandal having mobile no. 77021818352, Hem Kumar Jha having mobile no.09032711635, Deelip Mishra having phone no. 040-403771 and Md. Mohuddin having mobile no. 09985449215. Learned

No.4406 of 2016 (3) dt.10-05-2016 2/2 counsel for the petitioner further submitted that in view of the fact that the petitioner has neither received any amount from the informant nor his mobile number figured in any conversation with the informant, the petitioner's name has been unnecessarily dragged in the present case.

Learned counsel appearing on behalf of the State submits that mobile number referred to by the petitioner is not one of the mobile number rather four other numbers have come in the case diary, which does not include the mobile number of the petitioner.

In view of the facts, let ,above named petitioner, in the event of his arrest/surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ajay Kumar-II, learned Judicial Magistrate, 1st Class, Madhubani, District- Madhubani in connection with Benipatti P.S.Case No. 60 of 2014, subject to the conditions, as laid down u/s 438(2) Cr.P.C.
