JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Dariyapur P.S. Case No. 113 of 2023 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner is in custody since 06.03.2023 and there is recovery of 145 litres of illicit country made liquor from his possession and he has six excise antecedents.

Learned APP has vehemently opposed the prayer of bail.

Considering the period of custody and recovery of liquor from his possession, this application for regular bail is

Let the petitioner, above named, be released on bail after completing six months of custody on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-II-cum-Exclusive Special Judge-1st, Excise, Saran at Chapra in connection with Dariyapur P.S. Case No. 113 of 2023.

The petitioner will visit Dariyapur Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bond of the petitioner.
