The petitioner seeks modification of the order dated 21.09.2015 passed in Cr. Misc. no. 38346/2015 whereby a conditional anticipatory bail was granted to her on deposit of 25 % of the alleged embezzled amount of Rs. 435687.40 within a period of four weeks.
It has been submitted by the learned counsel for the petitioner that the petitioner being an old lady and did not have sufficient means to arrange the rest amount and now a demand draft of Rs. 1,09,000/- has been prepared which she is ready to deposit.
It has further been submitted that the said amount of Rs.
Patna High Court Cr.Misc. No.57513 of 2015 (2) dt.13-01-2016 2/2 109000/- i.e. 25 % be permitted to be deposited in the Court below. The said modification is allowed.
The learned counsel for the petitioner is directed to deposit 25% of the alleged embezzled amount within two weeks from today and in event of such deposit, the petitioner, in the event of her arrest or surrender before the Court below within a period of four weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur in connection with Raja Pakar P.S.Case no. 147 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr. P. C.
