JUSTICE RAKESH KUMAR ORAL ORDER 17-10-2017 Heard Sri Amresh Kumar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Special Case No.4731/17 arising out of Digha P.S. Case No.227/2017 registered for the offence under Sections 30(a)/ 35(A)/38(i) of of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender. At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. He further submits that save and except the confessional statement of the co-accused, there is no material to connect the petitioner.

Considering the fact that the petitioner's name has come on

No.45793 of 2017(2) dt.17-10-2017 2/2 the basis of confessional statement of co-accused as well as the petitioner is having clean antecedent, let the petitioner, namely, Sudil Kumar @ Sudhir Kumar @ Sudil Rai, in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No.4731/17 arising out of Digha P.S. Case No.227/2017, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
