The petitioner apprehends his arrest in connection with Mahnar P.S. Case No. 93 of 2021 registered for the offences under Sections 363 and 376(d) of the Indian Penal Code and Sections 4 and 8 of the POCSO Act.

Learned senior counsel for the petitioner has submitted that the petitioner has no role in the crime and he is the landlord and only allegation against him is that he locked the room when the main accused Nausad has taken the victim girl inside the room.

It is a case of rape and the girl is minor.

Considering the above facts, I am not inclined to grant

Patna High Court CR. MISC. No.37463 of 2021(2) dt.18-05-2022 2/2 anticipatory bail to the petitioner. This application for anticipatory bail is dismissed.

Petitioner is directed to surrender in the court below within two weeks from today.

During course of argument, learned counsel for the petitioner has submitted that the victim has entered into compromise with accused persons, namely, Deepak Kumar and Vishal Kumar.

It seems that the main accused persons, namely, Deepak Kumar and Vishal Kumar are tampering with the evidence.

The court below is directed to conclude the trial within six months from today.

Let a copy of this order be communicated to the learned Special Judge, POCSO Act, Vaishali at Hajipur. (Sandeep Kumar, J) BT/- U T
