The petitioner has preferred this application for grant of regular bail in a case registered under section 394 of the Indian Penal Code.

As per the prosecution case, four unknown accused persons assaulted the informant, forced him out of his vehicle and took away the vehicle.

On perusal of the petition it transpires that the case of the petitioner is that he has been falsely implicated in the case. The F.I.R was registered against unknown. No incriminating article has been recovered from his possession. The petitioner has not been put on T.I. Parade and the petitioner has been implicated on the basis of confessional statement of a co-accused made before police. He is in custody since

Heard learned A.P.P for the State.

Having heard learned A.P.P for the State and having perused the material on record it transpires that the F.I.R was registered against unknown. The name of the petitioner transpired in course of investigation in the confession of the co-accused made before police. So far as the alleged recovery of the vehicle is concerned, Bochahan P.S. Case no. 206 of 2021 has been registered for the same. In the instant case the petitioner is in custody since 25.11.2021 and charge-sheet has been submitted without putting the petitioner on T.I. Parade. In the facts of the case, the petitioner is directed to be enlarged on bail in connection with Bochahan P.S. Case no. 204 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Muzaffarpur (East), District- Muzaffarpur.
