JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Daudpur P.S. Case No. 97 of 2017, registered under Sections 341, 323, 326, 307 and 504/34 of the Indian Penal Code. The allegation of informant, Punita Devi, is that on 02.05.2017, at about 9. 45 A.M., when she made protest not to throw dirty water on her door then petitioner made attempt to cause injury at her neck through sickle, while she tried to save but she received injury at her right pinna. At that time, Renu Devi and Chandan Kumar caused injury at her through fist and slaps. Learned counsel for the petitioner submits that while the allegation has been made to cause injury through sickle at her

Patna High Court Cr.Misc. No.47640 of 2017 (2) dt.09-10-2017 right pinna, but the injury was lacerated wound which was occurred in course of scuffle not by sickle.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate Ist Class, Chapra at Saran, in connection with Daudpur P.S. Case No. 97 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
