The petitioner apprehends his arrest in a case registered under Sections 147, 149, 341, 323, 307, 506 and 504 of the Indian Penal Code.
Petitioner along with five other F.I.R. named accused persons are said to have abused and assaulted the informant over row of filling ditch by him. Petitioner and Mantu Sharma also assaulted the son of the informant namely Saurav Kumar inflicting bleeding head injury to him. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegation levelled against the petitioner is not specific rather
Patna High Court CR. MISC. No.25642 of 2019(2) dt.26-04-2019 2/2 general and omnibus in nature. There is a case and counter case between the parties. Though doctor has found only one fracture injury which is grievous in nature on the head of the victim but the assailant of the said injury is not ascertained. Petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnea in connection with Rupauli P.S. Case No. 48 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) mantreshwar/- U T
