2. The petitioner seeks regular bail in Motihari Muffasil P.S. Case No. 818 of 2023 registered for the offence punishable under Sections-363, 366(A)/34 of the Indian Penal Code and Section-8 of POCSO Act.

3. It is alleged that in the night of 01-11-2023, the accused persons came at the door of the informant and on call, while informant's minor daughter came out, the accused persons kidnapped her for the purpose of marriage.

4. It has been submitted on behalf of the petitioner that the petitioner is the father of co-accused Raju Yadav against

Patna High Court CR. MISC. No.32055 of 2024(5) dt.03-09-2024 2/2 whom, the victim had love and affection and she has solemnized marriage with him. It has further been submitted that the petitioner has falsely been implicated in the present case merely because he is father of co-accused Raju Yadav. The petitioner is under incarceration since 12-01-2024. The petitioner is a man of clean antecedent.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, East Champaran, Motihari in connection with Motihari Muffasil P.S. Case No. 818 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
