The contention of the petitioner is that the private road has been forcibly used for the construction of public road under the Mukhya Mantri Samekit Sahari Vikash Yojana. The construction of the road should be stopped. From the materials on record by the petitioner and the respondents, it appears the road has been laid/constructed. It is submitted that the petitioner, in that case, would be entitled to compensation if the respondent State take step for acquisition. It has also been submitted that part of the boundary wall put up by the petitioner and others was
Patna High Court CWJC No.4580 of 2013 (7) dt.22-01-2016 2/2 demolished in order to lay the road. None except the petitioner of the said locality has filed the present application. Without expressing any opinion on the claim of the petitioner, in my view, the petitioner may approach the District Magistrate, Patna ventilating the aforesaid grievance. If any such representation/application is filed, the respondent-District Magistrate shall examine the same and take appropriate step in accordance with law expeditiously.
