The parties are at liberty to have the issue duly answered after full-fledged trial and on account thereof, there is no need for directing the learned lower court to adjudicate the matter after framing preliminary issue relating to subject matter that means to say, version and counter-version over adoption made by respective parties.

Accordingly, instant petition is rejected.
