Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Kamal P.S Case No. 40 of 2024 registered for the offences punishable under Sections 302, 304B, 498A, 120B and 34 of the IPC, Sections 3 and 4 of Dowry Prohibition Act and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 19-2-2024 and the informant alleges that Sanjay fired causing injury on stomach of Nilu leading to her heath, thereafter Himanshu and Sudhanshu fired on temple and chest of his father leading to his death, thereafter petitioner along with

Patna High Court CR. MISC. No.29073 of 2025(3) dt.06-08-2025 2/2 Samrat caught elder brother of the informant and petitioner fired over the temple of elder brother of the informant, namely, Rajesh, causing his death.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case. 5.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that it is a case where three members of the family in one day, were killed and petitioner is alleged to have fired causing death of Rajesh. 6.

Considering the submissions made by the learned APP, the Court is not inclined to release the petitioner on bail. 7.

Accordingly, the prayer for regular bail of the petitioner is rejected.
