2. The petitioner in the present case is seeking regular bail in connection with Tekari P.S. Case No.460 of 2018 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code. He is in custody since 07.06.2023. The petitioner has got no criminal antecedent.
3. As per the prosecution story, the allegation against the petitioner is that he had committed murder of his wife due to non-fulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that the petitioner is the husband of the deceased and he has been falsely implicated in this case. Learned counsel has produced the certified copy of the deposition of the mother and father of the
Patna High Court CR. MISC. No.32181 of 2024(3) dt.14-11-2024 2/3 deceased to demonstrate that they have stated in their evidence that their daughter Guddi Devi died due to illness and that they have not supported the prosecution case.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Having regard to the facts and circumstances of the case wherein learned counsel for the petitioner has produced the certified copy of the deposition of the mother and father of the deceased to demonstrate that they have stated in their evidence that their daughter Guddi Devi died due to illness and that they have not supported the prosecution case as also that the petitioner is in custody since 07.06.2023, this Court directs release of the petitioner above named on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya in connection with Tekari P.S. Case No.460 of 2018, subject to the conditions as laid down under Section 437(3) Cr.P.C.
7. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for
Patna High Court CR. MISC. No.32181 of 2024(3) dt.14-11-2024 3/3 cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
8. This application stands allowed.
