2. In the present case, the petitioner seeks bail in connection with Gaurichak P.S. Case No. 10 of 2024 registered for the alleged offences under Section 307 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, the petitioner and other co-accused persons surrounded the son of the informant and this petitioner threatened him with a pistol but due to intervention of the associate of the son of the informant, the petitioner's shot misfired and thereafter at the instigation of co-accused wife of the petitioner, the son of the petitioner shot at the son of the informant.

4. Learned counsel for the petitioner submits that the

The son of the informant is himself a veteran criminal and accused in 13 cases. The son of the informant misbehaved with the wife of the petitioner and demanded extortion money and when she raised alarm, the son of the informant and his associate tried to flee away from the spot and the shot fired by the son of the informant accidentally hit him. Learned counsel further submits that the son of the informant has been demanding money as the petitioner is having his land near the house of the informant and he has been constructing house. Learned counsel further submits that the petitioner is having antecedent of 7 cases and he is on bail in 5 such cases. The petitioner is in custody since 16.11.2024 and charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court CR. MISC. No.26277 of 2025(2) dt.05-05-2025 3/3 learned Additional Chief Judicial Magistrate-II, Patna City, Patna/concerned Court in connection with Gaurichak P.S. Case No. 10 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
