JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Harsidhi P.S. Case No. 282 of 2016 registered under Sections 307, 506 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that, on 01.09.2016, at about 2.35 A.M., unknown fired in the room of informant through window while hit the wall passing through mosquito net but he did not sustained injury. Earlier petitioner has given threatening to the informant to shot fire.

Learned counsel for the petitioners submits that, in

Patna High Court Cr.Misc. No.55337 of 2016 (2) dt.23-12-2016 fact, petitioners and the informant are agnates and due to land dispute this false case has been lodged mere on suspicion. It is further submitted that the informant due to land dispute also got managed to lodge three other cases against the petitioners as detailed in paragraph 3 of the petition.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, in connection with Harsidhi P.S. Case No. 282 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
