The petitioner apprehends his arrest in Kathaiya P.S. Case No.17 of 2018 registered under Sections 448, 341, 323, 325, 307, 427, 386 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

The informant disclosed in his written report that while he had gone to ease out in the field situated by the side of his house, the petitioner and others came on two motorcycles and abused the informant making allegation that the informant got the illegal consignment of petitioner seized by the police and assaulted the wife of the informant. They also fired. Learned counsel for the petitioner submits that omnibus and general allegation is made against all the accused

Patna High Court CR. MISC. No.27336 of 2019(2) dt.26-04-2019 2/2 persons and Manvendra Singh and Birendra Thakur have already been enlarged on anticipatory bail by the coordinate bench of this court vide order passed in Cr.Misc.No.44689 of 2018 and Cr.Misc.No.43842 of 2018 and the case of the petitioner stands on the same footing.

Having considered the facts aforesaid and the fact the other similarly situated accused persons have been granted anticipatory bail by coordinate bench of this court, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, West, Muzaffarpur in connection with Kathaiya P.S. Case No.17 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
