JUSTICE JYOTI SARAN ORAL ORDER 15-01-2018 Heard Mr. Jitendra Kumar Roy, learned counsel for the petitioner and Mr. Alok Kumar Rahi, learned AC to GP-21, for the State.

The petitioner has prayed for a direction to the respondents to give him benefit of 2nd Assured Career Progression on completion of 24 years of service with effect from 16.10.2009 in the light of the Government decision bearing Memo No. 2015 dated 18.5.2009 and also make payment of differential amount admissible to the petitioner.

Mr. Roy, learned counsel appearing for the petitioner, while admitting to grant of 2nd Assured Career Progression to the petitioner vide Annexure 'A' to the counter affidavit submits that

Patna High Court CWJC No.157 of 2016 (2) dt.15-01-2018 the financial benefits have yet not been given to the petitioner i.e. differential of pay admissible to him. He further informs that the District Magistrate, East Champaran would be the authority concerned for the purpose.

Having heard learned counsel for the parties and considering that the benefit of 2nd Assured Career Progression has been given to the petitioner vide Annexure 'A' to the counter affidavit though financial benefits yet await the petitioner, I deem it proper to direct the District Magistrate, East Champaran to consider the grievance of the petitioner and dispose of the same within three months from the date of receipt/ production of a copy of this order.

The writ petition is disposed of accordingly. (Jyoti Saran, J) Surendra/- U
