JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-06-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 823 of 2018, disclosing offences under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

Petitioner happens to be husband of the complainant and allegation against him and others is of subjecting the complainant to torture and cruelty in connection with demand of dowry and of ousting from the house.

Submission of learned counsel for the petitioner is that entire allegation is false and concocted and he is still ready to keep the complainant with full honour and dignity and further no specific allegation has been attributed to the petitioner.

Patna High Court CR. MISC. No.25376 of 2019(3) dt.25-06-2019 2/2 Heard learned A.P.P. also.

It appears that in this case notice was issued to opposite party no. 2 and service report of notice disclosed that opposite party no. 2 has received the notice but nobody appears on behalf of opposite party no. 2.

Considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Nawada, in connection with Complaint Case No. 823 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
