JUSTICE ANIL KUMAR SINHA ORAL ORDER 09-11-2020 Heard Mr. Satya Prakash Parasar, learned counsel for the appellants on the Interlocutory Application filed on behalf of the appellant nos. 1 & 2 for modification of the order dated 24.09.2020 to the extent that learned counsel for the appellants at the time of passing of that order had submitted on instruction that all the appellants were arrested and had sought permission to withdraw this appeal. However, learned counsel for the appellants submits that due to communication gap it was submitted that all the appellants were arrested, whereas, only appellant nos. 3 & 4 were arrested and appellant nos. 1 & 2
Patna High Court CR. APP (SJ) No.1467 of 2020(4) dt.09-11-2020 2/2 were not arrested. However, learned counsel for the appellants submits that appellant nos. 1 & 2 also want to surrender and seek regular bail therefore the order dated 24.09.2020 may be modified to the aforesaid extent only.
Accordingly, let the order dated 24.09.2020 passed in the present appeal be modified to the extent that appellant nos. 1 & 2 seek permission to withdraw this appeal in order to surrender and seek regular bail.
Permission is granted.
The order dated 24.09.2020 is modified to the aforesaid extent.
