Petitioner seeks bail in connection Dinara (Bhanas) P.S. Case no. 224 of 2018 registered for the offence punishable under section 392 of the Indian Penal Code.
Learned senior counsel for the petitioner submits that petitioner is in custody since 03.04.2021 and charge sheet has been submitted. It has further been submitted that the informant alleges that four person riding on two motorcycles robbed the informant of his silver anklet amounting to Rs 32,000/- along with income tax paper, mobile etc. Learned senior counsel submits that petitioner is owner of jewelery shop and is neighbour of the informant and he has been falsely implicated in
Patna High Court CR. MISC. No.37112 of 2021(2) dt.07-12-2021 2/2 the present case and no incriminating article has been recovered from his possession which can be said that it was stolen. Learned APP opposes the prayer for bail.
Considering the facts that petitioner is in jail custody and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate III, Bikramganj District Rohtas in Dinara (Bhanas) P.S. Case no. 224 of 2018.
