Mr. SRI RAMCHANDRA SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ara Nawada P.S. Case No. 331 of 2017 for the offence under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the FIR. In the FIR the informant suspected the involvement of one Prashant Kumar Singh alias Bholu. The name of the petitioner surfaced during the course of investigation that he was also seen along with accused Prashant Kumar Singh alias Bholu and others. Out of the persons seen at the alleged place of occurrence, Amrit Raj alias Gollu, Madhurendra Kumar Tiwary and Sudhir Pandey have been granted anticipatory bail by this Court.

No.5999 of 2018(3) dt.17-02-2018 2/2 In view of the fact that this Court has granted anticipatory bail to similarly circumstanced co-accused Amrit Raj @ Gollu vide order dated 3.11.2017 in Cr. Misc. No. 48631 of 2017 and Madhurendra Kumar Tiwary and Sudhir Pandey have been granted anticipatory bail vide order dated 29.11.2017 in Cr. Misc. No. 50273 of 2017, let the petitioner, above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P. S. Case No. 331 of 2017, subject to the conditions as laid down under Section 438(2) Cr. P. C.
