The petitioner seeks anticipatory bail in Mahua P.S. Case No.11 of 2017 instituted for the offences under Sections 307, 324, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
This is the second attempt of anticipatory bail. Petitioner has approached this Court just after 30 days of the order dated 13.7.2017 passed in Cr. Misc. No.27967 of 2017. This Court has refused to grant anticipatory bail and directed the petitioner to surrender before court below. Instead of surrendering petitioner has approached this Court. In such view of the matter, this Court is not inclined to
Patna High Court Cr.Misc. No.41008 of 2017 (2) dt.13-09-2017 enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if petitioner does not surrender before the court below within three weeks from today this Court directs that the Officer In-charge must ensure arrest of the petitioner.
