2. Petitioner apprehends his arrest in connection with Samastipur Mahila P.S. Case No.46 of 2022, registered for the offences u/s 376, 354B and other allied Sections of the IPC and Section 4/6 of POCSO Act.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seek for regular bail, the learned Court below shall pass the order on the same day in accordance with law considering that the victim has herself not supported the prosecution case and some of the co-accused persons have been acquitted by the learned Trial Court in T.R.
