2. The petitioner is in custody in connection with Ara Nawada P.S Case No. 529 of 2023 from the Court of learned C.J.M Bhojpur at Ara registered for the offences punishable under Sections 302/34 of the I.P.C and 3 / 4 D.P Act.

3. As per allegation in the FIR, it is a case of murder and demand of dowry.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is next submitted that allegation of demand of dowry is false and concocted because the informant or the deceased never lodged any case for demand of dowry. It is also submitted that

Patna High Court CR. MISC. No.33141 of 2024(6) dt.27-09-2024 2/2 petitioner is in judicial custody since 26.09.2023 and petitioner has got no criminal antecedent as stated in para 3 of the petition.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. From perusal of the FIR, case diary, and other records of this case, it appears that petitioner is the husband of the deceased and the marriage solemnized between the petitioner and the victim on 17.02.2023, within five months of marriage victim died. From the perusal of the postmortem, report it appears that cause of death is asphyxia due to strangulation.

7. Considering the seriousness of the this case, I am not inclined to grant bail to the petitioner. Hence prayer for regular bail of the petitioner is hereby rejected.

8. However, the Trial Court is directed to conclude the trial expeditiously.
