JUSTICE SANJAY PRIYA ORAL ORDER 02-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 341, 323, 447, 324, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that the petitioner shot fire from his pistol which hit the thigh of husband of the informant namely, Vimal Sharma.
The learned Sessions Judge has mentioned in the impugned order that as per paragraphs 19 and 170 of the case diary, the husband of the informant sustained one gun shot injury and he was referred to PMCH, Patna, for better treatment. Considering that there is direction allegation against the petitioner of having fired which hit the thigh of the husband of
Patna High Court Cr.Misc. No.51886 of 2016 (4) dt.02-02-2017 2/2 the informant, I am not inclined to grant anticipatory bail to him. The prayer for anticipatory bail of the petitioner stands rejected.
The petitioner is directed to surrender before the court below and make prayer for regular bail which shall be considered by the court below on its own merit on the same day without being prejudiced by this order.
