The dead body of the son of the informant was found lying near the field c/kkj . The informant has raised suspicion against the petitioner and others.

Learned counsel for the petitioner submits that petitioner has been made accused along with others on the basis of suspicion and during the course of investigation no cogent material has come against the petitioner to connect him with the present offence. He next submits that cognizance against accused person namely Chitawan Yadav was taken in the year 2017, investigation against rest of the accused persons including the petitioner was pending and later on record was split up on 2/3/2017. The petitioner is in custody since 15-12021 and undertakes to co-operate in the trial regularly. He

Patna High Court CR. MISC. No.37660 of 2021(5) dt.12-05-2022 2/2 further submits that similarly situate Mahendra Yadav and Chintawan Yadav have been granted bail by different Coordinate Benches of this Court in Cr. Misc. Nos. 37535 / 2021 & 3275 of 2017 respectively.

Regard being had to the submissions made by the parties, taking into consideration the materials available on record, the fact that petitioner has been made accused on the basis of suspicion, he is in custody since 15/1/2021 , charge sheet has already been submitted and other similarly situated accused persons have been granted bail by this court, as such, I am inclined to grant regular bail to the petitioner. Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Gaya in connection with Tekari PS Case No. 312 / 2015 on the following condition:- (a) that the petitioner shall remain present on each and every date during the course of trial and in case of default on two consecutive dates on the part of the petitioner, his bail bond shall liable to be cancelled. praful/- (Anil Kumar Sinha, J) U T
