2. Learned counsel for the petitioner submits that the petitioner had earlier approached this Hon'ble Court seeking regular bail by filing Criminal Miscellaneous No. 1421 of 2025; however, the same was dismissed for default owing to noncompliance with the peremptory order dated 17.01.2025. Thereafter, the petitioner did not file any application for restoration of Criminal Miscellaneous No. 1421 of 2025 and instead thereof he has filed the present bail application afresh.
3. Learned counsel for the petitioner further submits that the FIR has been lodged against two named accused persons including the petitioner on recovery of a motorcycle along with one loaded pistol. Learned counsel further submits

No.29900 of 2025(3) dt.01-08-2025 2/3 that other co-accused Pintu Kumar has been granted bail by this Hon'ble Court vide order dated 03.01.2024 passed in Criminal Miscellaneous No. 71958 of 2024. The petitioner is in custody since 19.06.2024 and is accused in three more criminal cases.
4. Learned counsel for the State opposes the prayer for bail and submits that from the pleading it transpires that the petitioner in custody since about one year. He further submits that the report received from the learned Judicial Magistrate, 1st Class, Sitamarhi suggests that the charge has been framed and the case is presently pending at the stage of prosecution evidence and out of five prosecution witnesses, one has already been examined.
5. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Parihar P.S. Case No. 188 of 2024 subject to the conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 as well as further condition that at the time of furnishing bail bonds, the petitioner will produce substantial
