JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 427, 34 of the Indian Penal Code.

The prosecution case is that on protest being made by the informant for constructing the house on a disputed land the accused persons including the petitioners assaulted the informant and when the son and nephew of the informant came to rescue they were also assaulted. It is submitted by learned counsel for the petitioners that in the background of land dispute the accusation of assault has been levelled and the accusation is not being corroborated with the medical opinion. It appears that out of three injured two of them have received grievous

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Falka P.S. Case No. 168 of 2015, pending in the Court of learned Chief Judicial Magistrate, Katihar.

With the observations above, the application stands disposed off.
