JUSTICE SANJAY PRIYA ORAL ORDER 19-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 341, 447, 443, 323, 307 and Sections 354(A)/34 of the Indian Penal Code. It is alleged that while informant was sitting in her house, the FIR named accused persons armed with rifle, sword and Garansa arrived and assaulted the informant and on the point of rifle, they tied her husband in a pole with rope and started assaulting her. It is further alleged that when her daughter came to rescue, the accused persons also assaulted her. Further allegation is that the accused persons assaulted the informant on her head on account of which she fell on the ground and became unconscious. It has been submitted that the petitioner is not named

Patna High Court Cr.Misc. No.1775 of 2017 (2) dt.19-01-2017 2/2 in the First Information Report. The injury report of the injured is annexed as Annexure-3 wherein the police found simple injury on the person of the informant. The other co-accused namely, Deoraj Yadav and Tribhuwan Yadav @ Trigun Yadav have already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 19.12.2013 passed in Cr. Misc. 47858 of 2013. Considering the aforesaid facts and circumstances of the case, let the petitioner in the event of surrender, named above, within six weeks from the date of receipt of this order, in connection with Imamganj P.S. Case No. 112 of 2013, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sherghati at Gaya, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
