In this case, the petitioners are apprehending their arrest in connection with Gaighat P.S. Case No. 132 of 2017 registered for offences under sections 341, 323, 325, 354(A), 354(B), 307, 504/34 of the Indian Penal Code. As per allegation, in the night, the accused persons including the petitioners entered into the house of the Informant and started assaulting to him. Specific allegation has been made against the petitioner no.1 to have caused injury and petitioner no.2 has pointed the gun towards the Informant. In paragraph 13 of the case diary, it has been stated that an empty cartridge was
Patna High Court Cr.Misc. No.45902 of 2017 (2) dt.10-10-2017 recovered from the place of occurrence.
Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioners.
Accordingly, the prayer for anticipatory bail of the petitioners, above named, is rejected.
