The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 143, 149, 153, 153A, 154, 157, 158, 160, 188, 295, 295A, 298, 332, 341, 342, 323, 327, 353, 506 and 504 of the Indian Penal Code. The prosecution case is that there was apprehension of breach of peace between the Hindu and Muslim communities relating to possession of land.

It is submitted by learned counsel for the petitioners

Patna High Court Cr.Misc. No.54385 of 2015 (2) dt.01-12-2015 2/2 that the informant persuaded members of both the communities and pacified the issue. Considering the nature of accusation other co-accused persons have been granted anticipatory bail by a coordinate bench of this Court vide Criminal Miscellaneous Nos.45807 and 45847 of 2015. Moreover, no injury was caused to anyone.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, IV, East Champaran in connection with Madhuban P.S. Case No.197 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
