JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Bhagwanpur (Belaon) P.S. Case No. 65 of 2016 registered under Sections 409 and 420 of the I.P.C.

The accusation is that petitioner, being the Panchayat Teacher of Primary School, Basuhari, was handed over Rs. 122060/- for construction of Kitchen Shed for mid-day meal, but he has not completed the same and misappropriated the said money.

Learned counsel appearing on behalf of the petitioner submits that in fact, after completion of the work of kitchen shed, the petitioner has submitted an application on 28.07.2016 in the

Patna High Court Cr.Misc. No.36532 of 2016 (2) dt.16-09-2016 2/2 Office of District Program Officer, Mid-Day Meal Scheme, Kaimur and accordingly, the Block Education Officer also sent a letter through Memo no. 221 on 30.07.2016 to the Officer-inCharge, Belaon, Rampur, Kaimur, which would appear from Annexure-3 of the petition. As such, the petitioner has already completed the construction work of kitchen shed for mid-day meal.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M., Bhabua, Kaimur in connection with Bhagwanpur (Belaon) P.S. Case No. 65 of 2016, subject to the conditions laid down under Section 438(2) Cr. P.C.
