ANJANA MISHRA ORAL ORDER 19-01-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/323/324/307/379/504 and 34 of the Indian Penal Code. Learned counsel for the petitioners submits that the present altercation arose on account of land dispute between the parties. There is case and counter case with both parties having sustained injuries in the altercation. Learned counsel has brought on record the injuries reports sustained by both the parties by means of supplementary affidavit. He submits that as per the injury report, both parties have sustained injuries and the nature of some of the

Considering the nature of allegations and the history of litigations between the parties and also the fact that the petitioners have clean antecedent, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhubani in connection with Khajauli P.S. Case No. 53 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
