====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2022 Heard learned counsel for the petitioner and the State.

The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 420 and other ancillary sections of the Indian Penal Code. As per the prosecution case, several ATM cards of different banks have been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is working as a driver for last two years for coaccused Nilesh Kumar who runs an agency of motorcycle and petitioner had gone to Bhagalpur with his employer in connection with some business where he was apprehended,

Patna High Court CR. MISC. No.37217 of 2021(3) dt.04-01-2022 2/2 though there is no allegation of cheating or forgery against the petitioner. Petitioner has claimed clean antecedent and he is in custody since 28.12.2020. Charge sheet has already been submitted.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Kotwali Jogsar Police Station Case No. 815 of 2020.
