JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Sour Bazar (Patarghat O.P) P.S. Case No. 152 of 2016 registered under Sections 147, 148, 149, 341, 323, 379, 308, 504 and 506 of the Indian Penal Code.

The accusation is that on 27.04.2016 at about 1.30 P.M. informant was repairing his Bhusakhar at that time accused persons, including the petitioner, came variously armed with lathi and iron rod and started assaulting to the informant through iron rod. When Mukesh Kumar, brother of the informant, rushed to rescue him then he was also assaulted at his head through iron rod. In that course petitioner caused injury at the head of Kuma Devi, mother of the informant, who become unconscious.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.36490 of 2016 (2) dt.15-09-2016 2/2 allegation against the petitioner is that she assaulted the mother of the informant, but injuries found on the person of the Kuma Devi are simple in nature.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Sour Bazar (Patarghat O.P) P.S. Case No. 152 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
