Mr. SRI AJIT KUMAR ====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 23-02-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners apprehend their arrest in Arwal P.S. case no. 196 of 2017 instituted for the offence under Section(s) 147,148,149,341,323,336,379,307,295(A) and 153(A) of the Indian Penal Code.

Learned counsel for the petitioners has submitted that there is specific allegation against these petitioners. In the written report it is alleged that while the informant along with Ajay Kumar was returning to their house by motorcycle after

No.10222 of 2018(2) dt.23-02-2018 2/3 seeing the procession of Goddess Durga in the meantime, brick were thrown from the roof of the house of Aftab Alam of Shahi Mohalla and the informant sustained injury on head. It is further alleged that other people of muslim community armed with sword and lathi surrounded the informant and started assaulting them. The petitioner is named in the written report along with other accused persons. From the written report it is apparent that there is general and omnibus allegation against all these petitioners. There is no injury sustained by any body. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed.

In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Arwal P.S. case no. 196 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the C.J.M. Arwal, subject to the conditions as laid down under Section 438(2) Cr. P.C.

(3) if petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
