The claim of the petitioner keeping the circumstances of death of husband during duty hours has been accepted in principle, even in the counter affidavit filed on behalf of the respondents.
The consequential relief, therefore, has to flow in favour of the present petitioner, the widow, if the right to beget such benefits is not being disputed by the respondents in the counter affidavit.
If this be so, the writ application is disposed off with a direction upon the Commandant-Respondent No. 6 that the
Patna High Court CWJC No.18409 of 2014 dt.29-09-2016 2/2 necessary authorization and benefits, monitory or otherwise, will accrue to the petitioner, preferably within a period of three months from the date of communication / production of a copy of this order. Writ application stands disposed off with observation / direction as above.
