Petitioners apprehend their arrest in connection with Nadirganj P. S. Case No. 27 of 2017 instituted under Sections 323, 307, 341, 354(3), 379 and 506/34 of the Indian Penal Code. It is submitted that anticipatory bail application with respect to the petitioner no. 2 has become infructuous as he has been taken into custody, so his application stands dismissed as having become infructuous.

It is submitted that petitioner no. 1 had given loan to the husband of the informant. Petitioner was demanding money so this false case has been lodged after delay of two days without any explanation and the injury found on the person of the informant's husband is simple in nature and the petitioner has got no criminal

Having considered the aforesaid facts and circumstances, let the petitioner, namely, Shekha Singh, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nadirganj P.S.Case No. 27 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
