On 05.01.2015 also nobody had appeared on behalf of the petitioner and the case was disposed off on the basis of averments made in the counter affidavit. However, the case was passed over subsequently on the prayer of learned counsel for the petitioner. Today also nobody is appearing on behalf of the petitioner.

Learned counsel for the State submits that as per the averments made in the counter affidavit filed on behalf

Patna High Court CWJC No.18895 of 2008 (5) dt.07-01-2015 2/2 of respondent no. 5, the admitted dues of the petitioner have been paid to her. Copy of the counter affidavit has been served on learned counsel for the petitioner on 15.05.2012. Today neither anybody appears on behalf of the petitioner nor any rejoinder to the said counter affidavit is on record.
