Petitioner apprehends his arrest in connection with a case registered under Sections 420, 406, 409 and 120(B)/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with the Branch Manager of the Bank and Doctor of the Animal Husbandry Department misappropriated the loan amount sanctioned to the poor farmers for purchase of cattle. Submission is that petitioner is not a sanctioning authority of granting loan. His responsibility is limited to the extent of motivating poor farmers and making aware of them

Patna High Court Cr.Misc. No.5671 of 2017 (3) dt.22-02-2017 2 / 2 about the government scheme. Moreover the Manager of the Bank, who sanctioned the loan, has been granted anticipatory bail by a coordinate Bench of this Court by order dated 29.08.2016 vide Cr. Misc. No.34998 of 2016 and the case of the petitioner stands on much better footing.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Nawal Kumar be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad P.S. Case No.313 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
