The present writ petition was filed against an order of D.C.L.R. which was passed under the provisions of the Bihar Tenant Holdings (Maintenance of Records) Act, 1973. The order was passed under Section 15 of the Act. Even though there was statutory remedy of revision under Section 16 of the Act before the Collector the petitioner has directly approached this court. The court is of the opinion that since there is statutory remedy available to the petitioner, this court may not interfere with the matter. The writ petition stands disposed of granting
Patna High Court CWJC No.8556 of 2008 (8) dt.02-03-2015 2/2 liberty to the petitioner to approach the revisional authority. It is made clear that if such application is filed within a period of eight weeks from today, the learned court below may exclude the period consumed while pursuing the present writ petition i.e. the period of filing from 23.5.2008 till date.
