2. The petitioner seeks regular bail in connection with Batia P.S. Case No. 65 of 2024 registered for the offence under Sections 80(2), 103(1), 61(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The petitioner is the husband of the deceased. He is alleged to have killed the deceased.

4. Learned counsel for the petitioner submits that the deceased has committed suicide and this fact has been supported by some independent witnesses. They say that they have heard that the deceased had committed suicide. The dead body was brought out after breaking open the latch of the door. The petitioner is in custody since 18.09.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. I have gone through the Case Diary. From the description of the P.O., it does not appear that any latch etc., was found broken at the place of occurrence. It appears that the I.O. of the case has subsequently tried to plant so-called independent witnesses to make it a case of suicide.

7. Considering the fact that the petitioner is the husband of the deceased and is the main accused of killing his wife, I am not inclined to grant bail to the petitioner. Accordingly, this application for regular bail is hereby dismissed.
