JUSTICE ARUN KUMAR ORAL ORDER 08-02-2017 Heard learned counsel for the petitioners and the State. Petitioners apprehend their arrest in connection with Sonbarsa P.S. Case No. 153 of 2016 registered under sections 498A, 302 and 304(B) of the Indian Penal Code. Allegation is that the daughter of the complainant was taken away by her husband to Jammu Kashmir where she was living and thereafter she is traceless. It is suspected by the complainant that she was killed in connection with demand of dowry.

It is submitted that petitioner nos. 1 and 2 are mother in law and father in law living in village and the victim is traceless in Jammu Kashmir while living with her husband.

Patna High Court Cr.Misc. No.823 of 2017 (3) dt.08-02-2017 Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioners; (1) Sunaina Devi; and (2) Ram Kumar Bhagat be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sonbarsa P.S. Case No. 153 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.

However, the prayer for anticipatory bail of petitioner no. 3, shyambabu Kumar, who is the husband, is rejected. (Arun Kumar, J) S.Sb/- U T
