====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 12-02-2018 Heard Sri Arvind Prasad Singh, learned counsel for the petitioners and Sri Ajit Kumar, learned Addl. Public Prosecutor.
Six petitioners, apprehending their arrest in Arwal P.S. Case No.198/2017 registered for the offence under Sections 147, 148, 149, 341, 323, 120B, 504, 427 and 153A of the Indian Penal Code, have prayed for grant of bail, in the event of their arrest or surrender, primarily on the ground of parity.
It was submitted by learned counsel for the petitioners that some other accused persons, who were also arrayed as
Patna High Court Cr.Misc. No.6646 of 2018(2) dt.12-02-2018 2/3 accused in the F.I.R. have already been extended the privilege of anticipatory bail. Some of the accused persons, namely,(i) Rahul Kumar,(ii) Suraj Kumar (iii)Subodh Kumar, were granted anticipatory bail by order dated 16.01.2018 in Cr.Misc.No.61138 of 2017. Similarly, one Jitendra Kumar has been granted same privilege by order dated 03.01.2018 vide Cr.Misc.No.62162 of 2017. Learned Addl. Public Prosecutor was not in a position to distinguish the case of the petitioners with the case of others, who were extended the privilege of anticipatory bail. In view of the fact that some of the accused persons, in similar circumstances, have been extended the privilege of anticipatory bail, there is no reason to pass a different order.
Accordingly, let aforesaid six petitioners, namely, (i) Sajid Ansari @ Sajid Hussain (ii) Juman Quraishi (iii) Danish Joahar (iv)Sabir Quraishi (v) Laddan Quraishi and (vi) Bhajju Ansari @ Md. Khalid Hussain, in the event of their arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.
Patna High Court Cr.Misc. No.6646 of 2018(2) dt.12-02-2018 3/3 Magistrate, Arwal in connection with Arwal P.S. Case No.198/2017, subject to condition as laid down in Section 438(2) of the Code of Criminal Procedure.
