JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 2 17-09-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Maniyari P.S. Case No. 331 of 2019 for the offences under Sections 399, 402, 414, 467, 468 and 471 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has no criminal antecedent and he was not arrested at the spot; and his name was disclosed by coaccused Manoj Kumar in his confessional statement. He further submits that nothing was recovered from conscious possession of the petitioner, who is in custody since 21.12.2019. Considering the fact that the petitioner has no criminal antecedent; nothing was recovered from his conscious possession; and he has remained in custody for nearly nine months, the Court is inclined to grant bail to him. The petitioner,

named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction Sri Mahendra Mishra, Judicial Magistrate, 1st Class, West, Muzaffarpur in connection with Maniyari P.S. Case No. 331 of 2019.
