2. The petitioner is in custody in connection with Katra P.S. Case No. 182 of 2020 for the offence under Sections 307/34 of the Indian Penal Code as also Section 27 of the Arms Act lodged on 18.08.2020 by the informant, Navin Thakur.
3. As per the prosecution story, the informant recorded his statement in the emergency ward of S.K. Medical College and Hospital, Muzaffarpur alleging that a call came from outside whenafter, he came out and saw four persons on two motorcycles standing. A shot was fired which hit his shoulder. As he tried to snatch the revolver, repeated bullet injury was pumped into him which hit his abdomen and resulted into his being present in the emergency ward. Accordingly, the F.I.R.

No.30045 of 2024(5) dt.26-11-2024 2/2 has come that witnesses Uday Jha and Gopal Thakur stated that after hearing the sound of gunshot, they found Sawan Thakur, Vikram Paswan, Lalu Thakur (petitioner herein) and Gaurav Kumar Thakur retreating from the said place with revolver in their hand, thereafter, the injured was taken to S.K. Medical College and Hospital, Muzaffarpur. The further statement has been made that all these persons are indulged in liquor business and threatened everyone of dire consequences.
5. Though learned counsel for the petitioner tried to impress upon the Court about his innocence, learned APP, Mr. Bharat Bhusan, has taken this Court to paragraph-3 to show that he has eight criminal cases and in most of which, he is an accused of section 307 of the I.P.C.
6. Taking into account the aforesaid submission as also the statement of the witnesses in the case diary, this Court is not inclined to extend him any relief.
