The petitioner apprehends his arrest in Barhara P.S. case No. 218 of 2016 for the offences punishable under Section 308 and some other minor sections of the Indian Penal Code. The informant made allegation that petitioner assaulted him with iron rod on his head and blood started oozing out. Other accused persons also assaulted the informant with fists and slaps.
The learned counsel for the petitioner submits that there is a case and counter case. On behalf of petitioner Barhara P.S. case No. 219 of 2016 is registered. The occurrence took place on account of land dispute. The informant, Bipin Bihari, got simple injuries, as appears from Annexure-2, annexed with the
Patna High Court Cr.Misc. No.8285 of 2018 (2) dt.17-02-2018 2/2 bail petition.
Considering the facts that there is a case and counter case and both sides entered into scuffle or mutual assault in which the informant got simple injuries, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Barhara P.S. case No. 218 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
