Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioners seek anticipatory bail in connection with Complaint Case No. 2055 of 2016 for the offence punishable under Sections 468, 471, 420 and 406/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that compromise has taken place between the parties. Considering the above submission of learned
Patna High Court CR. MISC. No.37361 of 2021(3) dt.29-03-2022 2/2 counsel for the petitioners, this bail application is allowed. Accordingly, let the petitioners, above named, in the event of their arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Katihar, in connection with Complaint Case No. 2055 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, before accepting the bail bonds of the petitioners, the Court below shall verify from the opposite party no.2 whether there has been any compromise between the parties or not.
If it is found that the compromise has taken place between the parties then, the bail bonds of the petitioners shall be accepted by the Court below. If it is found that no such compromise has taken place between the parties, in such a situation, the Court below shall not accept the bail bonds of the petitioners and they shall be taken into custody.
